Will Smith Sued

A violinist alleges that he was fired by Will Smith in an act of retaliation after accusing the actor of sexual harassment.

According to People, artist Brian King Joseph, 34, filed a lawsuit in California Superior Court on December 30, 2025. In the complaint, Joseph accuses Will Smith, 58, of “intentionally cultivating an intimate relationship” with him for the purpose of future sexual abuse. The incidents allegedly occurred while Joseph was participating in Smith’s Based on a True Story: 2025 Tour last spring. Joseph is also suing the actor’s company, Treyball Studios Management, for wrongful termination after he reported an incident of sexual harassment.

According to the filing, Will Smith hired Brian King Joseph to perform for a tour stop in San Diego in November 2024. Following that, the actor invited Joseph to join his 2025 concert series to promote his new album. As their relationship grew closer, Smith reportedly told Joseph that “the two of them had a special connection unlike any he had ever had with anyone else,” along with other similar remarks.

When Will Smith held a concert in Las Vegas in March 2025, organizers booked local hotel rooms for the band and all crew members. Brian King Joseph stated that he lost a bag containing his room keys several hours before tour management found and returned them.

That evening, Joseph discovered that someone had unauthorized entry into his room, leaving behind several items including wet wipes, an HIV medication bottle with someone else’s name on it, a beer bottle, a red backpack, an earring, and hospital discharge papers for an individual Joseph did not know. He also received a handwritten note that read: “Brian, I will be back no later than 5:30, just the two of us together,” accompanied by a heart drawing and the signature “Stone F.”

Brian King Joseph stated that the content of the letter made him fear that “a stranger would soon return to the room to perform sexual acts” with him. He did not know exactly who left the message but asserted that only members of the tour staff could have accessed the room. Following the incident, Joseph notified hotel security and Smith’s representatives, while also reporting the matter to the police. A few days later, a member of Smith’s crew insulted him and informed him that he would be fired. This individual further implied that Joseph had fabricated the story.

According to the lawsuit, the harassment caused Joseph emotional distress, financial loss, damage to his reputation, and other grievances. He has also suffered from post-traumatic stress disorder (PTSD) and other mental health issues following his termination. Regarding compensation, he has left the amount for a jury to decide.

Currently, representatives for Will Smith have not responded to international news outlets regarding these allegations.

Judge Slaps Down Sexual Harassment Case …

Will Smith may have played the genie in the “Aladdin” remake, but now he’s the one getting his wishes granted … because a judge has tossed a sexual harassment suit against him, TMZ has learned.

As you know … violinist Brian King Joseph — who toured with Will last year — sued the actor a few months back for sexual harassment and wrongful termination regarding an alleged incident in 2025.

He claimed someone entered his Las Vegas hotel room when he wasn’t there and left a note that read, “Brian, I’ll be back … just us,” which he said was signed by “Stone F.” Brian claims the alleged intruder also left wipes, beer, and HIV meds. In the suit, he alleges Smith was grooming and priming him for sexual activity.

The violinist claims he was sacked for reporting the incident … but Will fought back and asked for the suit to be tossed.

TMZ obtained a copy of the judge’s ruling from Tuesday, which shows he agreed with the A-lister.

The judge says Brian’s suit doesn’t qualify as sexual harassment because it “fails to adequately allege conduct that is sufficiently severe or pervasive.”

He also writes BKJ hadn’t sufficiently pled facts that the only other people with access to his hotel room were Will or his management … because he’d left his bag with his room key in a van with other crew members before it was returned to him a couple hours later.

The judge tossed the case … but did give Brian the opportunity to amend his complaint and try to fix the problems that got it thrown out of court.
